Royal College welcomes decision on Bawa-Garba case

Dr Jackie Taylor, the President-Elect of the Royal College of Physicians and Surgeons of Glasgow has commented on behalf of the College following the ruling by the Court of Appeal on Monday 13th August to overturn the High Court’s decision to strike Dr Bawa-Garba off the medical register earlier this year.
Commenting following the ruling by the Court of Appeal on Monday 13th August to overturn the High Court’s decision to strike Dr Bawa-Garba off the medical register earlier this year, Dr Jackie Taylor, the President-Elect of the Royal College of Physicians and Surgeons of Glasgow said:
“We welcome this decision by the Court of Appeal.
“We particularly welcome the clarity that it has brought to the role of the Medical Practitioners’ Tribunal Service and the courts when dealing with medical issues.
“Today’s judgement also made clear that the original decision to suspend Dr Bawa-Garba from medical practice fully took into account the range of external factors and failures which led to the tragic death of Jack Adcock. Blaming a single individual for systematic failures is not appropriate and certainly not in the public interest.
“The current GMC review of gross negligence manslaughter and culpable homicide has also been brought into focus by this decision. We will continue to engage with this review and other bodies on behalf of our membership to ensure that they bring forward a range of constructive proposals.
“The whole profession now needs to reflect on this case in order to create a no-blame culture within the NHS, which would be in the best interests of patients, clinicians and the NHS as a whole.”
